OSHA’s Final Rule on the Tracking of Workplace Injuries and Illnesses

On January 25th, 2019 OSHA published it final rule on the Tracking of Workplace Injuries and Illnesses. This rule supersedes the previous rule issue in 2016, and eliminates much of the uncertainty it caused. Among the wins for foundries are the elimination of limits on safety incentive programs, and the ability to drug test employees when an industrial accident occurs. In addition, the new rule eliminates the need for foundries to report their OSHA 300 and 301 form data, though the Form 300A must still be submitted to OSHA. This change was made to address employers’ concerns about protecting employee privacy.
