Chemetco, Inc. operated a secondary copper smelter located in Hartford, Illinois, from 1969 until 2001. The Chemetco facility was shut down in October 2001, and Chemetco filed for bankruptcy in the Southern District of Illinois. A significant amount of hazardous material remains on-site related to their smelting and recovery operations. The U.S. EPA assessed the site for inclusion on the National Priority List under Superfund, and this location was placed on the National Priorities list in 2010. Because of its status as a Superfund site, the EPA began issuing notice of liability letters to the primary Potentially Responsible Parties (PRPs), with the last letter being mailed in January 2014.


The PRPs formed the Chemetco Site Group Agreement in 2015, when 162 companies signed an agreement amongst themselves to establish the group and establish committees that oversee all of the Remedial Investigation/Feasibility Study work, and to fund these efforts from contributions by the group members.

 

Subsequent investigation by experts retained by the working group discovered transactional data on the hard drive of a Chemetco Wang Computer. This data represents about 430 million pounds of materials that arrived at the Chemetco site, including both direct shipments to the site and materials that went through a warehouse and were consolidated into a shipment to Chemetco. Additional investigation has revealed other shipment data related to the warehouse transactions for materials that ultimately ended up at the Chemetco site as well.

 

Entities that potentially shipped hazardous materials directly to Chemetco, or through one of its warehouses, not included in the Primary PRP list have been identified in a SECONDARY PRP list. Your company may be included on the secondary PRP list if you sold any materials to Chemetco or its subsidiaries in the years prior to the firm’s bankruptcy. What does this mean if your company is on the secondary PRP list? It means your company may be liable for substantial costs for the site inspection and remediation/cleanup efforts required to clean this Superfund site. In addition, there could potentially be additional legal action taken by the U.S. EPA as well as by the Chemetco Site Group themselves to recover costs related to remediation of the site.

 

Several foundries have reported receiving a letter from the PRP working group and have identified that they may be on the secondary PRP list.
